Terms and Conditions

1. Services

Kelvin Jay Digitals (“Service Provider”) agrees to provide digital marketing services, including funnel building and strategy, online course creation, website design and building, automation setup, and related consulting (“Services”) as agreed in the project scope.

2. Payment Terms

  • Payment is due as outlined in the service agreement or invoice.

  • Payment plans may be offered on a case-by-case basis.

  • Services begin once initial payment or deposit is received.

  • Late payments may delay project timelines.

3. Project Timeline and Deliverables

  • Estimated delivery dates will be provided during project onboarding.

  • Timelines depend on timely feedback and approvals from the client.

  • Additional requests outside the agreed scope may affect cost and timing.

4. Client Responsibilities

  • Client agrees to provide all necessary content, access, and materials promptly to avoid delays.

  • Client acknowledges that delays in providing required information may impact project timelines.

5. Confidentiality

  • Both parties agree to keep confidential any proprietary or sensitive information shared during the project.

  • Confidential information shall not be disclosed to any third party without prior written consent.

6. Intellectual Property

  • All designs, funnel structures, wireframes, and related creative work produced by the Service Provider remain the intellectual property of Kelvin Jay Digitals.

  • The Service Provider reserves the right to showcase and share these designs publicly for portfolio and marketing purposes unless the client provides original wireframes, layouts, or proprietary materials that must remain confidential.

7. Support and Revisions

  • Post-launch support is included for 14 days unless otherwise specified.

  • Support covers bug fixes and minor adjustments related to the initial deliverables.

  • Additional work or revisions outside the agreed scope will be quoted and billed separately.

8. No Money-Back Guarantee

  • Due to the nature of digital marketing services, no refunds will be issued once work has commenced.

  • The Service Provider offers 30 days of support to ensure client satisfaction and address any issues arising from the deliverables.

9. Liability

  • The Service Provider shall not be held liable for any indirect, incidental, or consequential damages arising from the use or inability to use the delivered services or materials.

  • The client is responsible for complying with all applicable laws, platform terms, and regulations in using the deliverables.

10. Termination

  • Either party may terminate the agreement with written notice.

  • Payments made for completed work prior to termination are non-refundable.

  • Upon termination, all outstanding fees become due immediately.

11. Privacy and Data Protection

  • The Service Provider will handle any personal or business data shared in accordance with applicable data protection laws.

  • Client data will not be shared with third parties except as necessary to perform the agreed services or if required by law.

  • Both parties agree to implement reasonable security measures to protect shared confidential information.

12. Force Majeure

  • Neither party shall be held responsible for delays or failure to perform due to causes beyond their reasonable control, including but not limited to natural disasters, acts of government, or technical failures.

13. Governing Law

  • These terms are governed by the laws of the jurisdiction in which the Service Provider operates.
